Jharkhand’s new factory rules mandate reporting of canteen, creche (Childcare Centre), and rest house facilities in annual returns by 30th June. Non-compliance may lead to license suspension, with strict penalties for delays or false information.
The Jharkhand government has notified the implementation of the Factory (Amendment) Rules, 2025, under which factories must mandatorily provide information on canteens, creches, and rest houses in their annual returns, failing which could result in license suspension or cancellation. The Labour, Employment & Training Department has issued a notice requiring all factories to upload their annual returns by 30th June 2025, including details about these welfare facilities. If a factory fails to comply, its license may be seized under the revised regulations.
Mandatory Welfare Provisions Based on Workforce Strength
As per the amended rules Factories with over 250 workers must report details of canteen facilities. Factories employing more than 30 women must provide information on creche (Childcare Centre) arrangements. Factories with over 150 workers must report on rest house provisions for employees. This information must be submitted in Form-20 to the Chief Inspector of Factories by 15th January of the following year. A grace period allows submissions until 31st March with a penalty equal to 50% of the renewal fee.
Strict Penalties for Delay or False Reporting
Factories that fail to upload the return by 30th June, or provide false information, will be issued a show-cause notice via digital means or registered post. If a satisfactory response isn’t received, the registration certificate may be suspended or cancelled.
However, licenses can be reinstated with the approval of the Chief Factory Inspector, if the manager provides a reasonable explanation. Factories have the right to appeal against any order within 30 days through an online portal. The Principal Secretary of the Labour Department will serve as the appellate authority, and their decision will be final. This amendment aims to ensure better compliance with labour welfare norms and strengthen worker-centric infrastructure in industrial units across Jharkhand.
